Per multiple Supreme Court decisions, offering games of skill is a fundamental right under the Indian Constitution. This means that skill-based gaming platforms have constitutional protection to operate, and any restriction on such games must be carefully scrutinized against constitutional standards.

The High Courts of Karnataka and Calcutta have independently determined that law enforcement agencies cannot intervene in skill-based games like poker. Legal experts have concluded that internet poker and other skill-based gaming platforms are totally legal in India under the current legal framework.
